Preamble — Seller identification

The website www.maisonpechavy.fr (hereinafter the “Site”) is published and operated by:

PECHAVY ÉNERGIES ALTERNATIVES, a simplified joint-stock company (société par actions simplifiée – SAS) with share capital of €150,000, registered with the Agen Trade and Companies Register under number 750 580 565, SIRET 750 580 565 00018, intra-EU VAT number FR03 750 580 565, with registered office at 612 avenue du Brulhois – ZI Le Treil, 47520 Le Passage (d'Agen), France.

Hereinafter referred to as “MAISON PECHAVY” or the “Seller”.

Article 1 — Purpose and scope

These general terms and conditions of sale (the “GTC”) govern all sales of products concluded at a distance, via the Site, between MAISON PECHAVY and any natural person acting as a non-trader (the “Buyer” or “Customer”).

They apply to all sales made on the Site, regardless of the place of delivery: mainland France, Corsica, French overseas territories and abroad, under the conditions set out in Articles 6 and 8.

Any order placed on the Site implies the Buyer's unreserved acceptance of these GTC, to the exclusion of any other document. Validation of the order constitutes acceptance of the GTC in force on the day of the order. The GTC are accessible at any time on the Site and prevail over any other version or conflicting document.

MAISON PECHAVY reserves the right to amend these GTC at any time; the applicable terms are those in force on the date of the order.

Article 2 — Products

MAISON PECHAVY sells on the Site decorative items, lifestyle products, home fragrances and home accessories, as well as any other product presented on the Site.

The products offered are described and presented as accurately as possible. Photographs and visuals are for illustration only and do not form part of the contract; their consultation shall not engage the Seller's liability in the event of error or slight difference from the actual product.

Product offers are valid within the limits of available stock. Should a product become unavailable after the order is placed, MAISON PECHAVY will inform the Buyer as soon as possible and, where applicable, refund the sums paid for the unavailable product.

Article 3 — Prices and currencies

Product prices are stated inclusive of all taxes (VAT included), excluding delivery charges.

Prices are displayed in the currency applicable to the Buyer, according to the country of delivery: in euros (€) for the eurozone; in pounds sterling (£) for the United Kingdom; in Swiss francs (CHF) for Switzerland; in Canadian dollars (CA$) for Canada; in US dollars (USD) for other countries. Conversion is carried out at the exchange rate in force on the date of the order.

Delivery charges are indicated before validation of the order and invoiced in addition, in accordance with Article 6. The total amount due (products + delivery + where applicable import duties and taxes for international DDP orders, see Article 8) is summarised for the Buyer before final validation.

MAISON PECHAVY reserves the right to change its prices at any time; products are invoiced on the basis of the rates in force when the order is registered. Refunds are made in the currency of the order.

Article 4 — Order

The Buyer selects the products, adds them to the basket, then follows the order process through to its validation. Before final validation, the Buyer is able to check the details of the order, the total price and to correct any errors.

Validation of the order, after acceptance of these GTC, constitutes conclusion of the contract. MAISON PECHAVY sends the Buyer, by email, an acknowledgement confirming the order.

MAISON PECHAVY reserves the right to refuse or cancel any order in the event of a prior dispute, non-payment, or legitimate grounds, in particular where the order is abnormal in terms of quantities or manifestly fraudulent.

Article 5 — Payment

The price is payable in cash, in full, on the day the order is placed, by the means of payment offered on the Site:

Payments are secured. Payment data is transmitted in encrypted form and is not stored by MAISON PECHAVY.

The order is only definitively registered after confirmation of acceptance of payment. If payment is refused, the order is automatically cancelled.

MAISON PECHAVY retains full ownership of the products sold until full payment of the price has been received.

Article 6 — Delivery

6.1 Areas and terms

Products are delivered to the delivery address indicated by the Buyer when ordering. It is the Buyer's responsibility to verify the accuracy of this address; any parcel returned due to an incorrect or incomplete address will be reshipped at the Buyer's expense.

MAISON PECHAVY delivers to mainland France, Corsica, the French overseas territories and abroad, through carriers such as Colissimo, Chronopost, DPD and UPS. The specific terms applicable to international orders are set out in Article 8.

6.2 Timeframes

Delivery times are indicated when ordering, for guidance only. Unless otherwise stated, products are dispatched within:

In mainland France:

Express: 1 to 2 business days

Pickup point: 2 to 4 business days

Home delivery: 2 to 3 business days

Outside mainland France:

Express: 2 to 3 business days

Pickup point: 3 to 8 business days

Home delivery: 3 to 8 business days

In accordance with Article L.216-1 of the French Consumer Code, in the absence of any stated time, the Seller delivers without undue delay and no later than thirty (30) days after conclusion of the contract.

In the event of a delivery delay exceeding the announced time, the Buyer may, under the conditions of Articles L.216-6 et seq. of the French Consumer Code, require the Seller to deliver within a reasonable additional period and, failing that, terminate the contract and obtain a refund of the sums paid.

6.3 Transfer of risk

In accordance with Article L.216-4 of the French Consumer Code, the risk of loss or damage to the products passes to the Buyer at the time the Buyer, or a third party designated by the Buyer, takes physical possession of the products.

On receipt, the Buyer is invited to check the condition of the parcel and the products, and to report any anomaly (damage, missing item) to the carrier and the Seller as soon as possible.

Article 7 — Right of withdrawal (Buyers in France and the European Union)

7.1 Principle

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the consumer Buyer has a period of fourteen (14) days from receipt of the products to exercise the right of withdrawal, without having to give reasons or incur penalties.

7.2 Procedure

The Buyer exercises the right of withdrawal by notifying the Seller of the decision, before expiry of the period, by an unambiguous statement (by email to contact@maisonpechavy.fr). An acknowledgement on a durable medium is sent to the Buyer.

The Buyer returns the products without undue delay and no later than fourteen (14) days after communicating the decision to withdraw.

7.3 Return costs

Return costs are borne by the Buyer.

7.4 Refund

MAISON PECHAVY refunds all sums paid, including standard delivery charges (except for additional charges arising from a delivery method more expensive than the standard method offered), no later than fourteen (14) days from the date on which it is informed of the decision to withdraw. The Seller may withhold the refund until the products are recovered. The refund is made using the same means of payment as used for the order, unless expressly agreed otherwise.

7.5 Condition of products — exclusions

Products must be returned new, complete and in their original packaging, allowing them to be resold as new. The Buyer's liability may be engaged in the event of depreciation of the products resulting from handling beyond what is necessary to establish their nature and characteristics.

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply, in particular, to products made to the Buyer's specifications or clearly personalised.

Article 8 — International orders (outside mainland France and Corsica)

This article governs orders delivered to the French overseas territories and abroad. It prevails over any provision herein limiting deliveries to mainland France and Corsica.

8.1 “All-inclusive” pricing — DDP

For orders delivered outside the European Union, prices are understood as import duties and taxes paid (ICC 2020 Incoterm “DDP” – Delivered Duty Paid). The displayed price is “all-inclusive”: it includes transport, export and customs-clearance costs, customs duties and import taxes (including VAT) due in the destination country, as well as the associated bank and currency-exchange fees. The Buyer therefore has nothing to pay on delivery.

8.2 Returns — Buyers established in the European Union

The right of withdrawal under Article 7 applies on the same terms (refund of the price and of standard outbound delivery charges; return costs borne by the Buyer).

8.3 Returns — Buyers established outside the European Union

The statutory right of withdrawal under Articles L.221-18 et seq. does not apply automatically. MAISON PECHAVY nevertheless grants, on a commercial basis, a fourteen (14) day return right from receipt, under the following conditions:

return shipping and re-importation costs are borne by the Buyer;

the refund covers the price of the products only;

the initial delivery charges, as well as the customs duties and import taxes advanced by MAISON PECHAVY under the DDP sale, are non-refundable; they are refunded, where applicable, only up to the amounts actually recovered by MAISON PECHAVY from the customs authority of the destination country;

export and customs-clearance costs, as well as bank and currency-exchange fees, included in the “all-inclusive” DDP price, are non-refundable;

a deduction of 10% as restocking fees may be applied to change-of-mind returns;

products must be returned new, complete, in their original packaging, together with the invoice.

8.4 Non-conforming or damaged products

Any non-conformity noted on receipt must be reported to MAISON PECHAVY (contact@maisonpechavy.fr) on the day of receipt or, at the latest, within forty-eight (48) hours, together with photographs of the product, its packaging and the shipping label, and, where applicable, the reservations recorded on the carrier's delivery note. In the event of a product that is non-conforming, defective or damaged on delivery, MAISON PECHAVY bears all costs (return and, where applicable, reshipment) and refunds all sums paid.

8.5 International return procedure

Any return must be notified in advance to contact@maisonpechavy.fr in order to obtain a return number (RMA) and shipping instructions. The wording “RETURNED GOODS – NO COMMERCIAL VALUE FOR RESALE” and the return number must appear on the shipping documents to allow duty-free customs processing on re-importation. Any return made without prior agreement may be refused.

Article 9 — Legal guarantees

MAISON PECHAVY is liable for product conformity defects and for latent defects, under the conditions provided by law and set out below. These guarantees apply independently of any commercial warranty.

9.1 Legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code)

The Buyer has a period of two (2) years from delivery of the product to act under the legal guarantee of conformity. Where the delivered product does not correspond to what was expected, the Buyer may obtain its bringing into conformity by repair or replacement or, where this is impossible or disproportionate, a price reduction or rescission of the sale, under the conditions provided by law. The Buyer is exempt from proving the existence of the defect during the twenty-four (24) months following delivery, subject to Article 9.3.

9.2 Guarantee against latent defects (Articles 1641 et seq. of the French Civil Code)

The Buyer may also act under the guarantee against latent defects affecting the product, within two (2) years from discovery of the defect, and choose between rescission of the sale or a price reduction, in accordance with Article 1644 of the French Civil Code.

9.3 Assessment of conformity and exclusions

Conformity of the products is assessed at the time of their delivery. The legal guarantees cover defects existing at that date; they do not cover:

normal wear, consumption or normal depletion of the products, in particular consumable products such as candles, home fragrances, refills and diffusers;

alterations resulting from use not in accordance with the product's purpose, from failure to comply with the instructions for use, care or storage, from negligence, impact, or modification of the product by the Buyer or a third party;

minor variations in shade, appearance, material or fragrance inherent in the nature of artisanal or natural products.

In accordance with Article L.217-7 of the French Consumer Code, the presumption that the defect existed on the date of delivery does not apply where it is incompatible with the nature of the product, in particular for consumable or perishable products that have been used or consumed. For non-repairable products, bringing into conformity is carried out by replacement or, failing that, by price reduction or refund.

9.4 Implementation

To invoke a guarantee, the Buyer contacts MAISON PECHAVY at contact@maisonpechavy.fr, describing the defect and attaching any relevant supporting evidence (photographs, order reference). To allow assessment of the defect, the Buyer keeps the product and presents it, on request, in a condition allowing its verification; no claim may relate to a product that has been entirely consumed or used.

Article 10 — Liability and force majeure

10.1 Force majeure

MAISON PECHAVY shall not be held liable for the non-performance or delay in performance of its obligations resulting from an event of force majeure within the meaning of Article 1218 of the French Civil Code, such as in particular: natural disaster, adverse weather, fire, epidemic, strike, disruption of transport or communication networks, failure or delay attributable to the carrier, supply shortage beyond its control, or cyberattack. The occurrence of such an event suspends MAISON PECHAVY's obligations for its duration; if the impediment becomes permanent, the contract is terminated and the sums paid are refunded.

10.2 Use of products and safety

Products must be used in accordance with their purpose and with the safety, use and care instructions accompanying them. In particular, with regard to candles, home fragrances and products involving a naked flame or containing flammable or allergenic substances, the Buyer undertakes to comply with the stated precautions for use. MAISON PECHAVY's liability cannot be engaged for damage resulting from improper use, failure to comply with these instructions, negligence by the Buyer or the act of a third party.

10.3 Extent of liability

Where engaged, MAISON PECHAVY's liability is limited to direct and foreseeable damage resulting from the non-performance of its obligations. These provisions shall not exclude or limit MAISON PECHAVY's liability in cases where the law prohibits it, in particular under the legal guarantees (Article 9) or in the event of personal injury.

Article 11 — Personal data

The controller of the personal data collected on the Site is PECHAVY ÉNERGIES ALTERNATIVES, whose details appear in the preamble.

The data collected (identity, contact details, delivery and billing addresses, order and payment information) is processed for the following purposes: management and tracking of orders, delivery, invoicing, customer relations and service, compliance with legal and accounting obligations, and, where applicable, commercial communications under the conditions of the applicable regulations. The legal basis is the performance of the contract, compliance with MAISON PECHAVY's legal obligations and, for commercial prospecting, the Buyer's consent or legitimate interest as the case may be.

The data is intended for MAISON PECHAVY's departments and for its service providers involved in fulfilling the order (payment provider, carriers, host). It is not transferred to third parties for commercial purposes without the Buyer's consent. It is kept for the time necessary for the purposes pursued, extended by the legal retention periods, in particular accounting and tax periods.

In accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act, the Buyer has a right of access, rectification, erasure, restriction, objection and portability of their data, as well as the right to give directions concerning its fate after their death. These rights are exercised at contact@maisonpechavy.fr. The Buyer also has the right to lodge a complaint with the French data protection authority (CNIL).

Article 12 — Intellectual property

All elements of the Site (texts, visuals, photographs, logos, trademarks, including the MAISON PECHAVY trademark) are protected by copyright and trademark law. Any reproduction or representation, in whole or in part, without the prior written authorisation of MAISON PECHAVY, is prohibited and constitutes infringement.

Article 13 — Complaints and consumer mediation

13.1 Complaints

Any complaint may be sent to contact@maisonpechavy.fr or by post to: Service client MAISON PECHAVY – Z.I. du Treil, 612 av. du Brulhois – 47520 Le Passage d'Agen, France.

13.2 Mediation

In accordance with Articles L.612-1 et seq. of the French Consumer Code, after having submitted a written complaint to MAISON PECHAVY's customer service and failing a satisfactory response within one (1) year, the consumer Buyer may, free of charge, refer the matter to the consumer mediator on whom the Seller depends: the French National Energy Ombudsman (Médiateur National de l'Énergie), to be contacted via https://www.energie-mediateur.fr.

Article 14 — Governing law and disputes

These GTC and the sales arising from them are governed by French law.

In the event of a dispute, the parties will seek an amicable solution before any legal action. Failing an amicable agreement, and subject to the mandatory consumer-protection provisions of the consumer's country of residence, the French courts shall have jurisdiction.

Article 15 — Miscellaneous provisions

These GTC express the entirety of the parties' obligations. If any of their provisions were declared void or unenforceable, the other provisions would retain their full force.

MAISON PECHAVY archives contracts concluded at a distance and guarantees the Buyer access to them on request.

These GTC are in force as from 01/01/2026.

Article 16 — Gift vouchers / credit notes and promotional codes

Gift vouchers issued by MAISON PECHAVY are valid for 1 year on all Products offered on the Site. Gift vouchers may not be combined with one another or with promotional codes.

Promotional codes apply only to undiscounted base prices. Promotional codes may not be combined with one another or with gift vouchers. Promotional codes may be used once per Customer account unless otherwise instructed by MAISON PECHAVY. These codes are non-refundable in the event of an exchange.
